Many documents, from the time of Elizabeth 1 onwards, record the ancestry of Thomas Daniel, lord of Rathwire. Unfortunately they give different versions of this ancestry. They all say that his parents came from the Cheshire family of Daniels or Danyells, but they do not agree which branch of the family - Daresbury, Over Tabley or Cherry Tree Hurst. Their disagreements probably arise because they confused this Thomas Daniel (who died in or before 1482) with Thomas Daniel of Over Tabley, and with Thomas Daniel of Cherry Tree Hurst (who died in 1493). Other documents confused him with Thomas Daniel of Walsoken in Norfolk (who died in 1474). The only contemporary references to his parentage says that he was son of William Daniel of Daresbury. However this reference might be to another Thomas Daniel. Furthermore, even if it referred to the correct Thomas Daniel, we know that he was such a notorious liar that he might have fabricated his parentage. We know a few facts and have many possibilities for the parentage, siblings, and nephews and nieces of Thomas Danyell (see THOMAS for elaboration and justification):-

Thomas Danyell appears to have been a clever, charismatic, unscrupulous rogue - his exploits are recorded widely in contemporary and modern documents - the records are too extensive to include here, so most of them are summarised on a separate web page - THOMAS


EDMUND DANIEL

Many documents, from the time of Elizabeth 1 onwards, claimed this Edmund Daniel as a son of Thomas Daniel and Margaret Howard. Others said Thomas Daniel was childless.
The case against Thomas Daniel having legitimate children is based on the fact that Thomas Danyell was granted an heriditary lordship of Rathwire. There is as yet no particularly good counter to this arguement. Some possible counterpoints are:
  • A number of documents say the lordship of Rathwire was not a peerage and therefore not hereditary. However this arguement does not hold as the land grant appears to be hereditary.
  • Another possibility is that Thomas Daniel mis-behaved (yet again) and had the lordship taken away from him.
  • His son Edmund was on the wrong side at Bosworth so would then have lost any lordship, but that does not help as the lordship was given in 1482 to Thomas Fitzgerald after the death of Thomas Daniel and before Bosworth.
  • the lordship may have been exchanged for something else - it is clear from the 1482 document that the king wanted to return the lordship to its previous owner
  • Thomas Daniel could have had an elder son who lost the lordship for some mis-behaviour.
Although it is not possible to satisfactorily counter the arguement against Thomas Daniel having children, it is possible to provide a very strong case for him having a child Edmund and for this child being by Margaret Howard
  • a number of contemporary documents refer to Edmund son of Thomas Daniel, lord of Rathwire
  • a number of contemporary documents refer to the marriage of Thomas Daniel and Margaret Howard
  • John Howard, Duke of Norfolk, refers in his household books to his nephew Danyel - this is probably essential evidence
  • Edmund Daniel and a "little" Edmund are referred to frequently in the household books and are often mentioned immediately after the duke's children and with other nephews
  • an Edmund Daniel was executor of the will of the duke's widow - he would probably have joined the duke's household as a child at about the time of the duke's second marriage and so became close to this new and young wife
  • after Bosworth Edmund went with the duke's womenfolk under the protection of the Earl of Oxford
  • John Daniel, a cousin (or just possibly nephew) of Edmund, was a senior member of the Earl of Oxford's household
  • the Venerable Arthur Bell (great great great grandson of Edmund), in 1638, documented his family tree and recorded his royal descent via Margaret Howard
Margaret Daniel nee Howard is not mentioned in the household books so presumably had died before 1462. There is no reason to think there were children of Thomas Daniel or Margaret Howard other than Edmund. Original documents that confirm all of the above points are quoted in THOMAS.

- Edmund Danyell of Messing esquire 12/4/1560 - John Danyell of Cheppel parish esquire claims against him the manor of Baynard East 1560 - exemplification of the same, 2/10/1562 dispute between Edmund Daniel of Messing esquire and Robert Waldegrave and Henry Penyent gentleman re Peyton Shott - give to Danyell 4 and to others 6 - GOLDSBOROUGH.
- Edmund Danyell will 20/12/1568 1571 Messing Ess PROB 11/53 mentions wife Alice, son John under age, son in law Reg Hyegate a very long will.
- Edmund Daniel died 1570 - see HOWARD.
- Edmund Daniel was eldest son of Edmund and Grace Daniel - see HOWARD.
- Edmund had son and heir John who married Avice daughter of Sir Henry Tyrrell of Heron etc - see BELL.

- 1569 John Daniell matriculated as pensioner from Queens College Michaelmas 1569, perhaps admitted to Middle Temple 21/3/1570-1 as son and heir of Edmund Daniell esquire of Mining Baynards Essex (in Messing parish, see Morant II page 176) if so he inherited estate and died 15/12/1596 - also a number of Daniels from Colchester - Cambridge Alumni.
- John Daniel esquire of Messing (son of Edmund) died 1584 was married to Avice daughter of Sir Henry Tyrrell of Herons Essex - see HOWARD.
- John and Avice Daniel had children Alice Daniel who married Sir Andrew Astley of Essex and Ursula Daniel who married firstly William Wiseman of Great Baddow Essex son of George Wiseman of Upminster (and had children William Wiseman and John Wiseman) and secondly George Aylett gentleman of Coggeshall - see HOWARD.

- 1528 16/10 20th Henry 8 - John Danyell of Messyng Essex - exemption during the time he remains in the service of Elizabeth, Countess of Oxford, from being made sherrif etc of any county in England - Westminster - see STATE/Henry-8/4.2.2/2119/4896.
- 1528 8/7 - Elizabeth countess of Oxford to Wolsey - would gladly have complied with the request in his letter of the 2/7 to allow the master of his works to take stone and "calions" out of her cliff at Herwiche, but on sending her receiver Danyell thither top meet Wolsey's chaplains, it was found little could be spared without injury to the town as the cliff is not of stone, "but only the stone there remaining lieth as a forelonde to defend the same; if that were gone, the cliff to be washed away within short space". Wolsey may, however have as much as can be safely spared - see STATE/Henry-8/4.2.2/1962/4484.

- Thomas Daniel third son of the first Edmund took as wife Ann daughter of Sir Thomas Lucy of county Warwickshire - see BELL.
- Thomas Daniel - tomb with arms at Acton; 1488-1566 died aged 78; Acton previously owned by Clerbeck family - see ADD-MSS/19077.
- 1530 ...Thomas Clerbeck was succeeded by his son and heir Thomas who died in 1527 without issue, and was succeeded by his aunt Joan wife of William Partrich at whose death in 1530 the manor passed to her nephews William Lucy, Henry Mack-Williams, Edmund Walgrave, Roger Martin, Richard Merton, Edward Danyell, Thomas Ligate, Thomas Smerte, clerk and John Cordall. The manor was sold to Thomas Daniel third son of Edmund Daniel by Grace daughter and heir of Sir Richard Baynard knight of Messing in Essex which Edmund was son of Sir Thomas Daniell knight created Lord of Rathivire in Ireland by King Edward IV and Margaret his wife daughter of Sir Robert and sister of Thomas [sic] Howard Duke of Norfolk. Thomas Daniell the purchaser married firstly Anne daughter of Sir Edmund Lucy, and secondly Frances daughter of John Butler of Coventry, widow of Edward Felton of Oentlow in Essex .... - see Acton in COPINGER.
- 1542 Felton family - of this manor it is said that William Felton of Coddenham and Elizabeth his wife died seized of the manor 23/12/1495 but the inquisition on which no doubt the statement is based does not justify one in assuming Palmers to be a manor. The inquisition finds that William Felton died seized of a tenement called Palmers in Kedington worth £3 held of William Berneston in socage by the service of 4s also that Edmund Felton aged 32 was his son and heir - Inquisition Post Mortem 10th of Henry 7 page 1014 - William Felton had married Anne daughter and heir of Ralph Bancke and the so called manor or tenement passed to William's son Edmund Felton. He married firstly Anne daughter of John Borough (Broughton?) and secondly to Anne daughter of Sir Thomas Lucy [actually Sir Edmund Lucy] and resided at Glemsford. He died in 1519 when the manor passed to his son Edmund Felton, who married Frances, daughter of Francis Butler the Recorder of Coventry and died 10/12/1542 when the manor vested in his son George Felton who married Margaret daughter of John Carew of Bury. From George Felton the manor appears to have been acquired by John Spring of Hitcham for by his will dated 8/6/1544 he devises the manor by name to his executors for 11 years - Palmers Manor - see COPINGER/V/261 - see IQPM/Henry-7/1014.
- 1545 Thomas Daniel late of Sudbury bond by him and Thomas Felton to James Joskyn for £96 - 36 or 37 Henry VIII A 5358 - see Suffolk Records and MSS.
- Thomas third son of Edmund: grandson of Thomas Lord Daniel, was the first of his name living in Suffolk, taking the estate at Acton next to Melford before year ?. the Daniels originally came from county Cheshire, living at Clifton, Tabley and Desberry, less than six miles from Chester. A Savage married a Daniel daughter and heiress of Clifton, adding it to their hereditary property Rock Savage. This is all I know about the Daniel family at this stage 5th December 1638 - see BELL.
